By using this website and placing orders, you are deemed to have accepted the following terms:
All web pages on our site and related pages (the “Site”) belong to Dikor at www.dikor.com.tr and are operated by the Company. When you use all services offered on the Site (“User”), you agree to be bound by the following terms. By benefiting from and continuing to use the services on the Site, you represent that you have the legal right, authority and capacity to enter into a contract under applicable law, that you are over 18 years of age, that you have read and understood this agreement, and that you are bound by the terms set out herein.
This agreement imposes rights and obligations on the parties regarding the Site. When the parties accept this agreement, they declare that they will fulfil the said rights and obligations completely, accurately and on time, in accordance with the conditions required herein.
1. RESPONSIBILITIES
a. The Company reserves the right to change prices and products and services offered at any time.
b. The Company accepts and undertakes that the member will benefit from the services covered by this agreement except in cases of technical failures.
c. The User agrees not to reverse engineer the Site or engage in any other activity aimed at finding or obtaining source code; otherwise the User will be liable for damages arising to third parties and legal and criminal proceedings may be initiated.
d. The User agrees not to produce or share content that is contrary to public morals, unlawful, infringing third-party rights, misleading, offensive, obscene, pornographic, defamatory, infringing copyright, or encouraging illegal activity within the Site. Otherwise the User is fully responsible for any damage arising, and Site administrators may suspend or terminate such accounts and reserve the right to initiate legal proceedings. Therefore, if information requests are received from judicial authorities regarding accounts or activities, the right to disclose such information is reserved.
e. Relationships between Site members and each other or with third parties are the responsibility of the members themselves.
2. Intellectual Property Rights
2.1. All registered or unregistered intellectual property rights on this Site, including trade name, business name, trademark, patent, logo, design, information and methods, belong to the site operator or the stated rights holder and are protected under national and international law. Visiting this Site or using its services does not grant any rights regarding such intellectual property.
2.2. Information on the Site may not be reproduced, published, copied, presented and/or transmitted in any way. The whole or any part of the Site may not be used on another website without permission.
3. Confidential Information
3.1. The Company will not disclose personal information transmitted by users through the Site to third parties. Such personal information includes name, address, telephone number, mobile phone, e-mail address and any other information identifying the User, and is referred to as “Confidential Information”.
3.2. The User agrees and declares consent for the Company to share demographic and portfolio information with its affiliates or group companies, limited to use for marketing activities such as promotion, advertising, campaigns and announcements. This personal information may be used within the Company to determine customer profiles, offer promotions and campaigns suited to the profile, and for statistical studies.
3.3. Confidential Information may be disclosed to official authorities only when formally requested in accordance with mandatory provisions of applicable legislation.
4. Disclaimer of Warranties
THIS CLAUSE SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SERVICES PROVIDED BY THE COMPANY ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE COMPANY MAKES NO EXPRESS OR IMPLIED, STATUTORY OR OTHER WARRANTIES REGARDING THE SERVICES OR APPLICATION (INCLUDING ALL INFORMATION CONTAINED THEREIN), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
5. Registration and Security
The User must provide accurate, complete and up-to-date registration information. Otherwise this Agreement shall be deemed breached and the account may be closed without notice.
The User is responsible for password and account security on the Site and third-party sites. The Company cannot be held liable for data loss, security breaches or damage to hardware and devices arising otherwise.
6. Force Majeure
If obligations under this agreement cannot be performed due to causes beyond the parties’ control, including natural disasters, fire, explosions, civil war, war, riots, mobilisation, strikes, lockouts and epidemics, infrastructure and internet failures, power cuts (collectively “Force Majeure”), the parties shall not be liable. During such period, rights and obligations under this Agreement are suspended.
7. Integrity and Severability
If any provision of this agreement becomes invalid in whole or in part, the remaining provisions shall continue in full force and effect.
8. Amendments
The Company may change services on the Site and these terms in whole or in part at any time. Changes take effect from the date published on the Site. It is the User’s responsibility to follow changes. Continued use of the services constitutes acceptance of such changes.
9. Notices
All notices relating to this Agreement shall be sent via the Company’s known e-mail address and the e-mail address stated by the User in the membership form. The User accepts that the address given when registering is a valid address for service of notices and will notify the other party in writing within 5 days of any change; otherwise notices to that address shall be deemed valid.
10. Evidence Agreement
In any dispute between the parties regarding transactions under this agreement, the parties’ books, records, documents, computer records and fax records shall be accepted as evidence under applicable law, and the User agrees not to object to such records.
11. Dispute Resolution
Istanbul (Central) Courts and Enforcement Offices shall have exclusive jurisdiction over any dispute arising from the application or interpretation of this Agreement.
Personal Data Protection (KVKK / GDPR)
Dikor processes personal data submitted through contact forms, quote requests and dealer applications solely to respond to your enquiry, prepare offers and manage business relationships. Data are not sold to third parties. You may request access, correction or deletion of your data by contacting us at the e-mail address published on our contact page. For export customers outside Turkey, applicable local data protection laws may also apply alongside Turkish Law No. 6698 on the Protection of Personal Data (KVKK).
